Even if we got used to seeing Apple’s name involved in legal battles against big players of the industry, like Samsung and Motorola, it seems that even regular people can take giants like Apple to court, and win.
This story starts approximately four years ago, when a guy named Seattle Rex invested all of his savings into 17” MacBook Pro ( $4500 ) and he also purchased Apple Care extended warranty for which he paid $600.
So, after paying $5100, he was able to enjoy his Macbook without problems for three years. However, after the warranty expired, the Macbook malfunctioned.
After analyzing the device, it was discovered that the problem was caused by the NVIDIA GPU, for which Apple already issued a press statement announcing free repairs for all consumers who had this problem. Unfortunately, Seattle Rex was not eligible and he ended up paying another $600 for repairs.
After the repairs he tried to get his money back from Apple by sending emails to the company, explaining his problem. Seattle Rex also filed a complaint with the Better Business Bureau. He also filed a lawsuit against Apple asking for Apple to come clean and to give him a refund.
The good part of the story is that after a few months Seattle Rex went to court with Apple and he managed to win. The lawsuit was not complicated, as it only lasted for about one hour, during which, with the help of some computer knowledge, Rex managed to prove that the Macbook he purchased should have received free repairs from Apple.
The entire story can be found on Seattle Rex’s blog ( http://www.seattlerex.com ). However we would like to draw your attention into the following, a dialogue between the judge and the Apple representative. It seems that at some point the judge asked Apple’s representatives how much would have Apple spend to replace the problematic component. The Apple representatives answered that Apple would have spend 0 dollars because Nvidia pays for every GPU that has flaws.
This story goes to show that even if you are not Motorola or Samsung or any other industry giant, if you have problems you can go to court as a regular citizen and you can win. This also shows that sometimes, giants like Apple are doing the wrong thing and they get away with it simply because some of us do not take appropriate measures like Seattle Rex.
